Eligibility

• Event organizers may have additional eligibility requirements for their events, which will be specified by the organizer.
• Votestash may restrict or terminate accounts that do not comply with these Terms or applicable laws.

User Responsibilities

Voters

• You are responsible for ensuring the accuracy of your votes and any other information you submit on the Platform.
• You agree not to manipulate or attempt to manipulate voting results by using any means, such as automated tools, fake accounts, or other fraudulent methods.
• You will respect the rules of each event, as set by the event organizer, and comply with any guidelines for event participation.

Event Organizers

• You are responsible for accurately describing your event, including rules, eligibility requirements, voting criteria, and any associated fees.
• You agree not to misrepresent your event or the outcomes of voting.
• You will comply with all local, state, and federal regulations regarding the events you host on Votestash.
• Organizers are solely responsible for managing their events, including monitoring participation, ensuring the fair conduct of voting, and handling any disputes related to their events.

Event Creation and Participation

• Event organizers may create events in accordance with these Terms and any specific requirements outlined on the Platform.
• Votestash reserves the right to review, approve, or reject any event submitted for hosting on the Platform. If an event violates these Terms or applicable laws, we may remove or suspend the event.
• Users participating in events must adhere to the event’s specific rules and guidelines. Votestash is not responsible for verifying participants' compliance with event-specific rules.

Payment Processing, Platform Fees, and Revenue Sharing

• Payment Processing: All payments on the Platform, including participation fees or monetized votes, are processed by a third-party payment processor. By making payments through the Platform, you agree to the payment processor's terms and policies.
• Platform Fees:Votestash charges a service fee for facilitating events on the Platform. These fees are disclosed to event organizers upon event setup and are non-refundable unless otherwise stated.
• Revenue Sharing:Votestash offers revenue-sharing for monetized events, based on a defined percentage split. This percentage may occasionally change due to operational costs, and any adjustments will be communicated to event organizers.
• Settlement Disbursements: Revenue-sharing payments (settlements) will be transferred to the event organizer via the designated settlement account linked to their profile. These disbursements may incur additional processing fees, which vary based on the type of destination account—whether a bank account or a mobile money account. The applicable fees will be specified at the time of payment.
• Refund Policy: Payments made on the Platform are generally non-refundable. However, under certain conditions, Votestash may issue refunds at its sole discretion. Please contact support@Votestash.com for inquiries regarding refunds.

Content Ownership and Intellectual Property

• User-Generated Content: By submitting content on the Platform (such as event descriptions, images, and videos), you grant Votestash a non-exclusive, royalty-free, worldwide license to use, reproduce, distribute, and display this content in connection with the Platform’s services.
• Intellectual Property Rights: All intellectual property rights in the Platform, including its name, logo, trademarks, and design, are owned by Votestash or licensed to us by third parties. You agree not to use any of Votestash’s intellectual property without our express written permission.

Liability and Limitation of Liability

• No Warranties: The Platform is provided on an "as is" basis without warranties of any kind, express or implied. Votestash does not guarantee that the Platform will be available at all times, secure, error-free, or that it will meet your specific needs.
• Limitation of Liability: To the fullest extent permitted by law, Votestash, its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of profits or revenue arising from your use of the Platform.
• Indemnification: You agree to indemnify and hold Votestash harmless from any claims, losses, or damages arising out of your breach of these Terms, your participation in events, or your violation of any rights of another party.

Prohibited Activities

You may not use the Platform for any illegal or unauthorized purpose. Prohibited activities include but are not limited to:

• Manipulating or attempting to manipulate votes by fraudulent means.
• Using automated scripts or tools to interact with the Platform.
• Impersonating others or providing false information.
• Distributing malware, viruses, or any malicious code.
• Harassing, abusing, or harming other users.
• Engaging in activities that violate any local, state, national, or international laws or regulations.

Dispute Resolution

• Disputes Between Users: Votestash encourages users to resolve disputes directly between themselves. We are not responsible for any disputes arising between users or between users and event organizers.
• Disputes with Votestash: Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform will be resolved by binding arbitration. Both parties agree to waive any right to a trial by jury. This arbitration will be conducted in accordance with the rules of the American Arbitration Association or a comparable organization.
• Governing Law: These Terms are governed by and construed in accordance with the laws of Ghana.

Modification and Termination of Services

• Modification: Votestash reserves the right to modify, suspend, or discontinue the Platform or any part thereof at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or termination of services.
• Termination: We may suspend or terminate your account if you violate these Terms or engage in any prohibited activities. Upon termination, you will lose access to the Platform, and any ongoing events or transactions may be forfeited.
